Legal compromise agreements 

Often employers take advantage of their employees’ ignorance knowingly or unknowingly. Most employment related issues are easily resolved by agreements which do not need to go to court. However, as an employee, you must be represented strongly and your rights must be protected in order to obtain compensation, which is what the lawyers at Behr & Co Law Practice specialise in.

Andrew Campbell has practised for many years at the Employment Tribunal in Cardiff, both for employees and employers. Most of his cases involve a dismissal, alleged to be unfair. He may be able to offer no win no fee agreements for claimants with strong cases.

Employment Costs

Compromise agreements

The employer almost invariably agrees to meet the employee’s legal costs for signing these off, usually offering between £300 and £600. This is usually an acceptable fee for us, so the employee only has to pay if they do not sign the agreement or the employer fails to pay as agreed.


Unfair or wrongful dismissals

If you are the dismissed employee, we will usually assess your case and advise for our fixed minimum fee of £100 + VAT. 

If we consider the case sufficiently strong and the likely compensation adequate we may then offer a Damages Based Agreement, a type of no-win no-fee agreement, under which our fees on an outcome resulting in agreed or awarded compensation will be a fixed percentage, not exceeding 35%, of the compensation, and nothing if unsuccessful. Generally the only disbursements to be paid by the employee will be fees for an expert if needed, which is unusual in dismissal cases.

 We will act for employers, and other employees, on a time and work basis. The lawyer acting will be Andrew Campbell, charging £200 per hour plus VAT. He has more than 20 years experience of the Employment Tribunal and the County Court. Typical costs are between £1,000 and £10,000. There will usually be no disbursements except for an export report, or court fees if the matter proceeds in the County Court, both of which are unusual.


Disbursements

There are normally no disbursements in Employment cases, except for expert reports or counsel which is rare. Your lawyer will advise you if disbursements will be required in your case.
